Equal Enforcement under the law?

We watched our police chief, the night before the election, speak out at the selectmen's meeting, on live camera, regarding the actions of Mrs. Grant in placing fliers on the outside of mailboxes. Even after being directed by selectman Sullivan, not to mention any names, he STILL revealed the name of his "suspect".

He went on and on about the "violation" of federal law.

He called the postmaster and the postal inspector, personally.

He pulled the resident over and read them the law, and then revealed the story to the newspaper.

Now flash forward to this past week....

We have another far more involved flier distribution scheme under way in town. Phil has not appeared to rail against this instance of federal postal regulation violation.

He had Det. Farrar collect some of the fliers and look into the distribution of the fliers.

He failed to mention this at the meeting tonight as he did when the culprit was a critic of his.

He failed to rail publicly over this practice.

He failed to call the postal inspector for this instance.

He failed to call the postmaster in this instance.

He failed to call the newspaper in this instance.

Why are the two instances of the same offense being treated differently?

Could it have anything to do with the fact that this latest "violation" is merely a landscaper looking for business, and not a critic of Phil's?

Another self serving speech from a man who can not stand the least little bit of criticism.

Can someone verify for us what Phil said about that RSA? 105-2a I think he said. Does it really say the selectmen can not question his authority? I find that hard to believe as he is a town employee and therefore his boss!

One must always remember that all laws, local state and federal, have special clauses that state "This Law does not apply to Phil's friends. However, they do apply double to his enemies.

Interesting to see how the selectman respond to leon's letter to the selectman. My guess is the answers will be bla. But we will see. For the record tho, I heard the post master tell someone that the cheif came to him first.
Also the sign issue is not past as well....click my name for more info to the Atkinson-Factor.

RSA 105:2-a Police Chiefs; Powers; Dismissal. – Subject to such written formal policies as may be adopted by the appointing authority, each chief of police, superintendent of police, or city marshal of any city or town who is appointed rather than elected, shall have authority to direct and control all employees of his or her department in their normal course of duty and shall be responsible for the efficient and economical use of all department equipment. Such chief, superintendent, or city marshal shall be subject to suspension without pay or dismissal only for cause, and after he or she has been presented with a written specification of the reasons. Upon such suspension or dismissal, he or she shall be entitled to a hearing, on the merits and reasonableness of the action, in superior court in the county in which the municipality is located, provided that he or she petitions the clerk of the superior court for such a hearing within 45 days of his or her suspension or dismissal. The court shall have the power to affirm, modify, or negate such suspension or dismissal, based upon its findings.

This pretty much describes how the BOS can fire his a**. As usual, the chief is having a little difficulty with reading comprehension.

There are a lot of things that don't pass the sniff test at APD. And I think it all starts at the top with Phil and Billy and Deputy Joanne Consentino. Let's keep an eye on the 3 Musketeers and start looking for Phil's replacement now.

Here's a thought. The BOS can relieve the chief through the process above, and he'll go kicking and screaming (he's very good at that). How about something he can't do anything about?

How about the BOS remove him as Director of Elderly Affairs. It's volunteer and it's appointed. He serves strictly at the will of the BOS.

It would be a start at cleaning up the messy financials between the PD and EA.

Won't win the board any popularity contests but it would show some back bone.

We take no small measure of umbrage at such a hostile official act against this BLOG’s patron. Therefore, a timely Editorial comment is both appropriate and necessary.

Discussion of Atkinson’s financial direction, from any viewpoint, is fundamental and encouraged and we will always attempt to limit and correct errors.

However, Righteous indignation towards purported error of such inconsequential nature is not appropriate.

The ENTIRE car deal is problematic. If it was caused by poor judgement, improper exercise of authority, neglect or mistake or even specious reasoning, this will never trump the facts that the entire questionable transaction started and ended within a very small circle of confidants.

We find the entire circumstances surrounding the disposition of the police Cruiser highly irregular at the least and the "explanations" somewhat trifling and exhaustive of our intellect.

Mr. Consentino: It’s time to go. Being Chief of Atkinson’s Police Department is NOT a birthright. That is a fabled legend of yesteryear.

Historically in Atkinson, police chief appointments were made "under the hand of the selectmen" for terms of one year at a time, as was also the case in the beginning of Mr. Consentino’s assorted and discontinuous stream of appointments to this position.

Your only remaining credential established on a claim of indispensability has faded.

So time is neigh. Plan a graceful exit, Clean out your desk, Accept the gratitude and tearful sentiments from some. We plan no editorial recriminations. It is time. Thank you for your service, We wish you a long and happy retirement. Bon Voyage.

"To All Atkinson Residents,

I am writing to ask for your help. A member of the Atkinson Police Department needs our help. I am here to ask for your help in Corporal John Lapham's fight for his life. As you are aware, John has been diagnosed with Leukemia. He has been once again hospitalized with an infection that is threatening his life. He is one of the bravest people that I have ever met. He has never asked of anything from the residents of the town. Now is our chance to step up and help both him and his family out. As everyone is aware John has been out of work for a few months. His family has been busy helping John to get better. He needs our help, and I am hoping that this town can step up to the plate and help. From the moment that I met John, I have admired him. He does alot, but never asks for anything in return. He has helped so many people in this town. I for one am one of those people. Please help him.

There is a fund set-up in his name at TDBanknorth in Plaistow. Any amount will help John, while he is out of work. It would be great if this town could help ease a burden off his wife.
